DIRECTOR GENERAL OF FOREIGN TRADE,

Considering :

• 1. that, with regard to the issuance of Decree of the Minister of Industry and Trade Number 411/MPP/KEP/6/2003 on Amendment To Decree of the Minister of Industry and Trade Number 756/MPP/KEP/11/2000 Concerning Import of Non-New Machineries And Machinery Equipments, it is considered necessary to stipulate implementation of the said Decree of the Minister of Industry and Trade;
• 2. that, for that purpose, a Decision of the Director General of Foreign Trade has to be issued.

In view of :

• 1. Decree of the Minister of Industry and Trade Number 756/MPP/KEP/11/2002 on Import of Non-New Machineries And Machinery Equipments;
• 2. Decree of the Minister of Industry and Trade Number 411/MPP/KEP/6/2003 on Amendment To Decree of the Minister of Industry and Trade Number 756/MPP/KEP/11/2002 Concerning Import of Non-New Machineries And Machinery Equipments.

DECIDES:

To stipulate :

DECREE OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON IMPLEMENTING GUIDANCE OF DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO.411MPP/KEP/6/2003 ON AMENDMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE NUMBER 756/MPP/KEP/11/2002 ON IMPORT OF NON-NEW MACHINERIES AND MACHINERY EQUIPMENTS

Article 1

(1) Non-new machineries and machinery equipments which are imported based on Decrees of the Minister of Industry and Trade Number 756/MPP/KEP/11/2002 and Number 411/MPP/KEP/6/2003 must be examined by the Surveyor.

(2) Examination by Surveyor as contemplated in paragraph (1) above is conducted before shipping in the loading country.

(3) to the importation of non-new machineries and machinery equipments the goods of which arrive at an Indonesian Port until August 21, 2003 can still be examined by the Surveyor in the Unloading point.

Article 2

(1) Results of examination by the Surveyor as contemplated in Article 1 shall be reinstated in the dorm of Certificate of Inspection.

(2) Procedures and method of examination by the Surveyor are made and implemented by the Surveyor in accordance with the prevailing common practice in the framework of examination and issuance of Certificate of Inspection.

Article 3

(1) All costs incurred for examination of non-new machineries and machinery equipments and issuance of the Certificate of Inspection as contemplated in Articles 1 and 2 hereof shall be liability of the relevant importer.

(2) The amount of costs as contemplated in paragraph (1) above is adjusted to the benefit principle.

(3) Procedures and method of payment for costs that is liability of the importer to the Surveyor shall be implemented in accordance with the custom in the framework of payment by a party for a service rendered by another party.

Article 4

This Decree shall come to effect as from the date of stipulation.
